User Agreement

This User Agreement is prepared and published in compliance to the provisions of Information Technology Act, 2000 and various rules and regulations as amended from time to time read together with Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011.

This User Agreement along-with Privacy Policy, inter alia, and other rules and regulations define the broad framework for access or usage of www.buyonlineclasses.com website.

The domain name www.buyonlineclasses.com (hereinafter referred to as "Website") is owned by e- Learning Academy, a proprietory concern owned by Vivek Goel having office at XI - 11 & 12, 1 st Floor, Globsyn Cyrstals, Block EP, Sector V, Salt Lake Etectronics Complex, Kolkata – 700091, West Bengal , India (hereinafter referred to as "BOC").

The User of this website gives his/her implied consent to the terms and conditions and other defining policies, as amended from time to time, as laid down by e-Learning Academy, the owner of this website. The User shall also be bound by the terms and conditions applicable to such service he/she avails on this website.

In this Agreement, unless the context otherwise requires,-

  • ‘User’ shall mean any natural or legal person who has Login or registered or surf/access/browse or has become a buyer or Seller on the Website and has also been addressed as ‘You’ wherever required.
  • ‘BOC’, ‘buyonlineclasses.com’, ‘e- Learning Academy’ and ‘website’ has been interchangeably used and has also been addressed as ’We’, ’Us’, ’Our’.
  • ‘Sellers’ are the persons or entities which offer for sale their products or services on the electronic
    • platform provided by e-Learning Academy for a consideration and also include ‘Service Provider’.
  • ‘Buyers’ are the customers who make purchases of the products and services offered for sale on the electronic platform provided by e-Learning Academy for payment of a consideration.

Rights of BOC

  • BOC shall be well within its rights to change, modify, add or delete any portion(s) of this User Agreement, from time to time without any prior written notice.
  • In case BOC has reasonable grounds to believe that any information provided by the User on the website is untrue, inaccurate, not current or incomplete, or not in accordance withthis User Agreement, it shall suspend or block access the User to the Website and take such remedial action it deems fit to withdraw such unwarranted material from its website.
  • BOC shall, in case of non-compliance by the User with the rules and regulations by whichever name called or User Agreement or privacy policy etc, shall terminate the access or usage of such User to its website without any prior information.
  • BOC reserves the right to change its Fee Policy from time to time. BOC reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be.
  • BOC may at its sole discretion introduce new services and modify some or all of the existing services offered on the Website.
  • BOC shall upon coming to its knowledge about the presence of any information prohibited in Rule 3(2) of the Information Technology (Intermediaries guidelines) Rules, 2011 shall act to disable such information from its website.
  • BOC shall preserve such information prohibited in Rule 3(2) of the Information Technology (Intermediaries guidelines) Rules, 2011 hosted on its website along-with all the associated records for the investigation purpose and shall make them available to any Government agencies, if required.
  • BOC reserve the right, but has no obligation, to monitor the materials posted on the Website.

Obligation of the User:

  • User shall periodically review the User Agreement for any updates and changes.
  • User shall provide information on the website which is true, accurate, current and complete.
  • You shall be solely responsible for compliance of all applicable laws including those in India for making payments to E-Learning Academy.
  • In strict compliance to the provisions of Rule 3(2) of the Information Technology (Intermediaries guidelines) Rules, 2011 the User shall be under obligation and duty bound not to host, display, upload, modify, publish, transmit, update or share any information which:
    • (i) belongs to another person and to which You does not have any right to;
    • (ii) is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; or unlawfully threatening or unlawfully harassing including but not limited to "indecent representation of women" within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986;
    • (iii) is misleading in any way;
    • (iv) promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
    • (v) infringes upon any patent, trademark, copyright or any other, intellectual property rights;
    • (vi) violates any law for the time being in force;
    • (vii) deceives or misleads the addressee/ users about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
    • (viii)impersonate another person;
    • (ix) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
    • (x) threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.
  • The User shall not engage in any undesirable activities and shall not use any abusive, derogatory or unparliamentary language in its postings on the website
  • The User shall not engage in any kind of hacking, password "mining" or any other illegitimate activities.
  • The User shall adhere to the provisions of the Information Technology Act, 2000 and rules thereunder as applicable and as amended from time to time.

Communications

BOC and the User can also communicate via emails or other mode of communication, electronic or otherwise.

Charges

BOC does not charge any fee for Membership registration, browsing and buying on the Website. However, any changes in fee structure shall be posted on the website along-with with the effective date.

Disclaimer:

  • The User shall be solely responsible for the materials posted by him on the website.
  • The views of the User shall not be in conformity with the views of BOC with respect to any material hosted by the User on this website. In no event shall BOC assume or have any responsibility or liability for any Content posted or for any claims, damages or losses resulting from use of Content and/or appearance of Content on the Website.
  • In case the website is hacked or upon an unforeseen event or any undesirable or unauthorized intrusion or force majure the security of the website is compromised for no fault on the part of BOC We shall in no way be held liable for any loss or damage caused to the User as a result of the same.
  • BOC does not warrant that:
    • (i) This Website will be constantly available, or available at all times; or
    • (ii)The information on this Website with respect to the products, materials and services offered by the Seller or any information by any other User is complete, true, accurate or non-misleading though BOC will undertake all efforts to ensure only complete, true, accurate or non-misleading information is hoisted on its website to maintain its high standard of creditability.
  • BOC shall not be liable for any loss incurred or damage caused to any party on the action taken based on any information, correct or incorrect, posted by the User. The dispute shall be resolved between the Buyer and the Seller mutually.

Our Privacy Policy is available on our website. We have taken reasonable security measures in terms of the provisions of Information Technology Act 2000 and Rules thereunder to protect the sensitive information collected.

Advertisements on Buyonlineclasses.com:

We use third-party advertising entities to serve ads on our Website. Any action taken by the User based on the ads shall be the sole discretion of such User and the website has no role to play and shall not be responsible in any manner whatsoever for any consequences.

Payment Facility for Buyers:

All the payments with BOC shall be transacted either in electronic form such as RTGS or NEFT or netbanking, wallets, paytm etc.as informed on the website from time to time. In certain circumstances BOC may decide to accept payment through Cash on Delivery mode. provided by the website•

BOC reserves the right to refuse to process Transactions initiated by Buyers which it considers as undesirable and/ or having a prior history of questionable conduct or behavior

The Buyer and Provider acknowledge that BOC will not be liable for any damages, interests or claims etc. resulting from not processing a Transaction/Transaction Price or any delay in processing a Transaction/Transaction Price which is beyond control of BOC.

Compliance with Laws:

Buyer and Provider shall comply with all the applicable laws of the land while conducting any transaction through this website.

Indemnity

You shall indemnify and hold harmless BOC from any claim or demand, or actions or penalty , made by any third party due to the breach on your part of this User Agreement, privacy Policy and other Policies, or any violation of any law, rules or regulations or the rights of a third party.

Applicable Law

User Agreement shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Kolkata.

Jurisdictional Issues/Sale in India Only

Unless otherwise specified, the material on the Website is presented solely for the purpose of sale in India.

Trademark, Copyright and Restriction

This website is owned, managed and operated by BOC and is an electronic platform meant for the products/ services to be sold by respective Seller. The contents of this website are covered by copyrights, trademarks, and other intellectual property rights
